Dr. Shaban’s Speech in Napoli ( Mediterranean lawyers)

Ladies and gentlemen, friends and colleagues, welcome and good morning,
This great event to meet with distinguished lawyers and thinkers from diverse background of the Mediterranean.
I would like to thank you for your invitation to this very important conference.
As I said yesterday, it was a good opportunity to work together in this deep and fruitful discussion and dialogue. We have spoken about immigrants /immigration, refugees/asylum, disposal nuclear and chemical weapons
We have spoken about peace , security, dangers of international terrorism. We will discuss today one of the most important subjects, which is the Arab-Israeli conflict.
- First, it is important danger of losing civil rights/ freedom to mention the Palestinian right for self-determination.
- Second, we must condemn Israeli aggression.
- Third, we must look at the reality of severe racism in the State of Israel.

There must be a global demand for the implementation of the UN resolution No. 478, Aug 1980 which condemns, “Israel s attempted annexation of East Jerusalem,” (Al Quds).

The resolutions made by American President Donald Trump -- which recently declared Jerusalem (Al Quds) as the Israeli capital and the Golan are illegitimate and should not be granted legal binding for Israel is breaking International Humanitarian Law, Contemporary International Law, and the Geneva Convention (1949) by continuing with the occupation of Palestine.

It should also be taken into consideration that UN resolution No. 497, Dec, 1981 refers to the Golan as Syrian land.


Article 3 of the Geneva Convention 1949 states:

In the case of armed conflict not of an international character occurring in the territory of one of the High Contracting Parties, each Party to the conflict shall be bound to apply, as a minimum, the following provisions:
(1) Persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat by sickness, wounds, detention,´-or-any other cause, shall in all circumstances be treated humanely, without any adverse distinction founded on race, colour, religion´-or-faith, sex, birth´-or-wealth,´-or-any other similar criteria.”

The aggression on Gaza, which has been under siege since 2007, includes blocked sanctions against water, food, medicine, health access and building materials.
Distinguished British artist BANKSY said in 2014 “Gaza is often described as the world s largest open air prison because no one is allowed to enter´-or-leave. But that seems a bit unfair to prisons – they don’t have their electricity and drinking water cut off randomly almost everyday.”

I am interested in philosophy and history of this case, because behind any problem´-or-problematic issue there are three stages:
1. Political
2. Legal
3. Moral

From the establishment of the State of Israel in May 1948, 71 years ago, until today, Israel has fought the Arab world:
- 1956, Israel attacks Egypt with British and French
- 1967, Egypt, Syria, and Jordan, the “Six Day War”
- 1973, Syria (Golan), Egypt
- 1978, South Lebanon
- 1982, across Lebanon until Israel occupied the capital Beirut
- 2006, Lebanon
- 2008, 2012, and 2014, Palestine (Gaza)

The philosophy from this political case:
- Israel fosters aggression
- Israel is against peace and security in the Middle East
- Israeli behaviours are immoral.
- Apartheid against the people of occupied Palestine is present in the State of Israel.
This is the wisdom of the philosophy and the experience of the history.
