Sweden: Mr. Bijan Ghahramani at Risk of Deportation to Iran

The Swedish authorities are preparing to deport asylum-seeker Mr. Bijan Ghahramani to Iran, where he would be at high risk of detention or other forms of serious harm such as torture.

The case:

Defend International (DI) has been informed by reliable sources about the risk of deportation of Mr. Bijan
Ghahramani, a prominent active member of Kurdistan Democratic Party of Iran (PDKI).

According to Mr. Bijan Ghahramani, he was born in the city of Mahabad, in the Kurdish region of Iran. He grew up there, and his family (his parents, wife and two children) still live there. For political reason he was forced to leave the country. On 4 October 2006 he arrived in Sweden, where his two brothers were already living. On 10 October 2006 he sought asylum. His application was rejected by the Swedish Board of Immigration on 28 April 2008, and his appeal against that decision was rejected on 2 March 2009.

DI Views & Demands:
DI is greatly concerned about the safety of Mr. Bijan Ghahramani if returned to Iran. In view of his past involvement with PDKI and the very act of having applied for asylum in Sweden, DI fears that Mr. Ghahramani will be subjected to torture and detained upon his involuntary deportation to Iran, mainly because the Supreme Court of Iran has already sentenced him to two years’ imprisonment for his political views.

Sweden is a state party to several international human rights instruments that expressly prohibit deportation to countries where there are substantial grounds for believing that the person would be in danger of being subjected to torture.

I am concerned that Mr. Ghahramani will be subjected to torture and detained upon his involuntary return to Iran, especially because the Supreme Court of Iran had sentenced him to two years’ imprisonment for expressing political opinions. Sweden has obligations under the Convention Against Torture, the International Convention on Civil and Political Rights and other international treaties. Under these international obligations Sweden has a responsibility not to deport people to countries where they are at risk of torture or ill-treatment.
