نحث السلطات على وضع حد لجميع اشكال المضايقة، بما في ذلك على المستوى القضائي، ضد السيد محمد المسقطي وجميع اعضاء جمعية شباب البحرين لحقوق الانسان.
حملة لمنظمة الدفاع الدولية بالتعاون مع "المرصد" ـ الفائز بجائزة حقوق الانسان للجمهورية الفرنسية للعام 1998
"المرصد" لحماية المدافعين عن حقوق الانسان، وهو برنامج مشترك بين الاتحاد الدولي لحقوق الانسان ومركزه في باريس/فرنسا، والمنظمة العالمية لمناهضة التعذيب ومركزها في جنيف/سويسرا، ويهدف البرنامج الى تقديم الدعم الملموس للمدافعين في وقت الحاجة.

القضية:
السيد محمد المسقطي هو رئيس جمعية شباب البحرين لحقوق الانسان، والتي تنظم حلقات تدريبية وترصد انتهاكات حقوق الانسان وتشارك في تكوين شبكة اقليمية للشباب الناشطين في مجال حقوق الانسان في ثماني دول عربية.
بدأت يوم الثلاثاء 27 نوفمبر 2007، محاكمة الشاب محمد المسقطي وذلك أمام المحكمة الصغرى الجنائية الرابعة، بناءاً على تهم "مباشرة نشاط جمعية قبل صدور بيان تسجيلها".
وترتبط هذه التهم لكون جمعية شباب البحرين لحقوق الانسان لم تحصل على قبول التسجيل بسبب الاجراءات المتشددة المدرجه في قانون العقوبات البحريني لعام 1976 وقانون الجمعيات لعام 1989، والتي تتضمن شروطا لتسجيل المنظمات غير الحكومية وتجريما لتشكيل أية مجموعة بدون موافقة السلطات، وعدم التدخل في القضايا السياسية، و تشترط أن يكون جميع الأعضاء فوق سن الثامنة عشرة.
ووفقا لهذه القوانين فهناك قلق من صدور حكم بالسجن ستة اشهر ودفع غرامة 5000 دينار.
وقبل هذه المحاكمة تلقى اعضاء جمعية شباب البحرين لحقوق الانسان اخطارا من وزارة الشؤون الاجتماعية مطالبة وقف انشطتها او مواجهة المحاكمة. وكانت جمعية شباب البحرين لحقوق الانسان قد قدمت للتسجيل في حزيران / يونية 2005 ومنذ ذلك الحين لم تتلقى اي جواب من السلطات.
جلسة الإستماع الاخيرة ستكون في 21 كانون الثاني / يناير 2008.
موقفنا:
تعرب منظمة الدفاع الدولية والمرصد عن بالغ قلقهما بشأن هذه الاجراءات القضائية ضد السيد محمد المسقطي والتي تنبع من اتخاذ تدابير تشريعية تدل على تصميم السلطات للسيطرة او اسكات المنظمات المستقلة، والى الحد من وجود المنظمات غير الحكومية على الاراضي البحرينية.
مطالبنا:
نحث السلطات على وضع حد لجميع اشكال المضايقة، بما في ذلك على المستوى القضائي، ضد السيد محمد المسقطي وجميع اعضاء جمعية شباب البحرين لحقوق الانسان، وتكفل في جميع الظروف ان اعضاء الجمعية قادرون للقيام بعملهم بحرية من دون أي عوائق.
ندعو السلطات الى وضع حد لجميع اشكال المضايقة ضد المدافعين عن حقوق الانسان في البحرين.
ونحثهم على الالتزام بأحكام اعلان الامم المتحدة بشأن المدافعين عن حقوق الانسان، الذي اعتمدته الجمعية العامة للامم المتحدة في 9 كانون الاول / ديسمبر 1998 ، ولا سيما المادة (1) ، التي تنص على ان "لكل شخص الحق ، بمفرده وفي بالاشتراك مع غيره ، ان يدعو ويسعى من اجل حمايه وتحقيق حقوق الانسان والحريات الاساسية على الصعيدين الوطني والدولي "، والمادة 11 ، التي تنص على ان" لكل شخص الحق ، بمفرده وبالاشتراك مع غيره، الحق الشرعي ممارسته او مهنة "، وكذلك المادة 12 (1) تنص على ان" لكل شخص الحق، بمفرده وبالاشتراك مع غيره، ان يشترك في الانشطة السلمية لمناهضة انتهاكات حقوق الانسان والحريات الاساسية ".

Finally I urge you to ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with the Universal Declaration of Human Rights and with international and regional human rights instruments ratified by Bahrain.
