اوزبكستان: استمرار مضايقات السلطات لنشطاء حقوق الانسان

كشف النقاب في مقال عن تبديل طفلتين في المستشفى قبل اكثر من خمسة عشر عام يؤدي اليوم الى رفع قضية وحبس انفرادي لكاتب المقال
حملة لمنظمة الدفاع الدولية بالتعاون مع "المرصد" ـ الفائز بجائزة حقوق الانسان للجمهورية الفرنسية للعام 1998
"المرصد" لحماية المدافعين عن حقوق الانسان، وهو برنامج مشترك بين الاتحاد الدولي لحقوق الانسان ومركزه في باريس/فرنسا، والمنظمة العالمية لمناهضة التعذيب ومركزها في جنيف/سويسرا، ويهدف البرنامج الى تقديم الدعم الملموس للمدافعين في وقت الحاجة.

القضية:
تلقت منظمة الدفاع الدولية نداءاً وتقريراً من "المرصد" بخصوص الحبس الانفرادي للسيد صُبير تولاكانوف، مدير فرع طشقـند لجمعية حقوق الانسان في اوزبكستان(hrsu)، مطالبة منظمة الدفاع الدولية بالتدخل العاجل في هذه القضية.
ووفقاً للمعلومات الواردة: ذهب السيد تولاكانوف في 19 سبتمبر 2007 الى محكمة الجنايات في منطقة يوزونه باد من اجل التقصي عن اوراق القضية المرفوعة ضده من قبل السيدة فيروزا سوكاتبيفا في 13 نيسان/ابريل 2007، حسب المادة 139 من القانون الجنائي الاوزبكي. ومع ذلك، فلم يُسمح له بالاطلاع على اوراق القضية، بل تم احتجازه ايضاً في مقر المحكمه بناءاً على قرار من القاضي الذي قرر بتحويل اجباري لاقامته الملزمة منذ عام 2007، في اطار الاجراءات القضائية ضده، الى السجن. ومنذ ذلك الوقت والسيد تولاكانوف في حبسه الانفرادي وفي مكان مجهول.
وكانت السيدة سوكاتبيفا قد رفعت شكوى ضد السيد تولاكانوف بعد نشره لمقال في صحيفة محلية، منتقداً مستشفيات الولادة الاوزبكية، بعدما تم مؤخراً كشف النقاب عن تبديل ابنته وابنة السيدة سوكاتبيفا لخطأ من موظفي المستشفى بعد ايام قليلة من ولادتهم، لاكثر من خمسة عشر عام مضت.
منذ تقديم الشكوى امام محكمة الجنايات في يوزونه باد في 13 نيسان/ابريل حدثت سلسلة من المخالفات الاجرائية:
* اولاً وقبل كل شيء، لاحظ "المرصد" بانه لم يتم تم إخطار السيد تولاكانوف حول وجود الشكوى المرفوعة ضده الا في 26 يوليو 2007 ( اي بعد مرور 71 يوماً منذ فتح اجراءات التحقيق، في 16 أيار / مايو) وبالتالي لم يتمكن من ادخال جميع العناصر والنقاط المهمة برأيه في قضيته والتي كان سيتم اعتمادها للدفاع عنه ضمن الوقت المخصص "90 يوماً من التحقيق" كما ينص عليه القانون.
* في 27 يوليه /تموز 2007 خضع السيد تولاكانوف لاستجواب من قبل السيد الماتوف، حيث قدم ضابط التحقيق التابعة لادارة الشؤون الداخلية لمقاطعة يوزونه باد بعد ذلك شكوى الى المدعي العام لمدينة طشقـند السيد فالييف، وذلك احتجاجاً على المخالفات الاجرائية التي واجهها السيد تولاكانوف. ولكنه لم يتلقى اي جواب حتى الان.
* وفي 17 آب / اغسطس 2007 ، اعلن السيد الماتوف ان إجراءات التحقيق التى افتُتحت يوم 16 مايو 2007 كانت مغلقة، في الوقت الذي لم يكن لديه الحق للامر بجعلها مغلقة.
موقف ومطالب منظمة الدفاع الدولية:
ترى منظمة الدفاع الدولية بان اعتقال السيد تولاكانوف هو اعتقال تعسفي. ويهدف هذا الاعتقال بالدرجة الاولى الى معاقبته بسبب نشاطاته في مجال حقوق الانسان. وفي ضوء هذه الحقائق، فما لجئت اليه الحكومة الاوزبكية يعتبر انتهاكاً للعهد الدولي للحقوق المدنية والسياسية، التي هي طرف فيه.
المادة 9.1 من العهد تنص: لكل فرد الحق في الحرية والامان على شخصه. لا يجوز اخضاع احد للاعتقال او الاحتجاز التعسفي. ولا يجوز حرمان احد من حريته الا لاسباب ووفقاً للاجراءات المنصوص عليها في القانون.
وعلاوة على ذلك ، فلكون مكان احتجاز السيد تولاكانوف لا يزال مجهولاً حتى الان، فان الحكومة الاوزبكية تخالف المادة 9.3 من العهد، التي تشترط ان:
يقدم الموقوف او المعتقل بتهمة جنائية للمثول فوراً امام قاضي او موظف آخر مخول حسب القانون لممارسة السلطة القضائية، ويكون من حقه ان يحاكم خلال مهلة معقولة او ان يفرج عنه.
تحث منظمة الدفاع الدولية السلطات الاوزبكية على الافراج الفوري وغير المشروط عن السيد تولاكانوف وعلى اتخاذ كافة الترتيبات لاعطائه فرصة الحصول على محامٍٍ من اختياره ولقاء أسرته والحصول على اي علاج طبي قد يحتاجه.

He was reportedly detained on September 19, 2007 in Criminal Court of the Yuzunabad District, and is now held at an unknown location.
I am very concerned that he is detained incommunicado, where torture is most frequently practiced according to the UN Special Rapporteur on Torture. I urge you to guarantee in all circumstances the physical and psychological integrity of Mr. Tulaganov.
I call on you to release him immediately and unconditionally as his detention is arbitrary, as it seems to aim at merely sanctioning his human rights activities.
Furthermore I urge you to take all necessary measures to put an end to all acts of harassment and threats against Mr. Tulaganov as well as against all human rights defenders in the country.
I call on you to ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Uzbekistan.
I would like to remind the authorities that Mr. Tulaganov must be given immediate access to a lawyer of his own choosing, his family and any medical treatment he may require.
I hope for your urgent attention to this matter.
