تأكيد حكم الإعدام على السيد عدنان حسن بور واسقاط الحكم بحق السيد عبد الواحد (هيوا) بوتيمار.
حملة لمنظمة الدفاع الدولية بالتعاون مع "المرصد" ـ الفائز بجائزة حقوق الانسان للجمهورية الفرنسية للعام 1998
"المرصد" لحماية المدافعين عن حقوق الانسان، وهو برنامج مشترك بين الاتحاد الدولي لحقوق الانسان ومركزه في باريس/فرنسا، والمنظمة العالمية لمناهضة التعذيب ومركزها في جنيف/سويسرا، ويهدف البرنامج الى تقديم الدعم الملموس للمدافعين في وقت الحاجة.

القضية:

تلقت منظمة الدفاع الدولية نداءاً وتقريراً من "المرصد" بخصوص تأكيد حكم الاعدام على السيد عدنان حسن بور وكذلك اسقاط القضية بحق السيد عبدالواحد بوتيمار، وهما صحفيين كرديين وعضوين نشيطين في المجتمع المدني في ايران. وناشدت المرصد منظمة الدفاع الدولية بالتدخل العاجل في هذه القضية.

ووفقاً للمعلومات الواردة:
في 22 تشرين الاول / اكتوبر 2007، أيدت المحكمة العليا الايرانية حكم الاعدام على السيد عدنان حسن بور الصادر في يوم 9 يوليه 2007 من قبل محكمة الثورة الايرانية في ماريوان، لـ"تهم" منها "الهجمات على الامن القومي" و"الخيانة" و"التعاون مع احزاب معارضة سياسية".
وفي اليوم نفسه الغت محكمة اخرى قرار محكمة الثورة الايرانية بشأن السيد عبدالواحد بوتيمار لوجود مخالفات اجرائية. ولا يزال السيد بوتيمار محتجزاً، في انتظار ان تحال قضيته الى محكمة اخرى.

ومع ذلك، فان قرارات المحكمه العليا الايرانية قد نشرت للتو، ولم يتم ابلاغ الناشطين، وهو شرط يسبق تقديم الاستئناف بالنسبة للسيد حسن بور.


موقف ومطالب منظمة الدفاع الدولية:

تعرب منظمة الدفاع الدولية والمرصد عن بالغ قلقهما بشأن تأكيد حكم الإعدام على السيد حسن بور الذي وكما يبدو يهدف مباشرة الى معاقبة كل نشطاء حقوق الانسان.

وتذكّر المنظمتان بان العديد من هيئات الأمم المتحدة، بما فيها اللجنة المعنية بحقوق الانسان التابعة للأمم المتحدة، ولجنة الامم المتحدة لمناهضة التعذيب والمقرر الخاص للأمم المتحدة المعني بالتعذيب ، قد دعو الى الغاء عقوبة الاعدام.

القانون الدولي
العهد الدولي للحقوق المدنية والسياسية ينص على ما يلي :
المادة 6
1. الحق في الحياة حق ملازم لكل إنسان. وعلى القانون أن يحمى هذا الحق. ولا يجوز حرمان أحد من حياته تعسفا.
2. لا يجوز في البلدان التي لم تلغ عقوبة الإعدام، أن يحكم بهذه العقوبة إلا جزاء على أشد الجرائم خطورة وفقا للتشريع النافذ وقت ارتكاب الجريمة وغير المخالف لأحكام هذا العهد ولاتفاقية منع جريمة الإبادة الجماعية والمعاقبة عليها....

ومن الواضح ان هذا لا يمكن باي حال من الاحوال ان يشمل التعبير السلمي عن معارضة المواطنين لاي امر من الامور المتعلقة بحقوقهم.

وتكرر المنظمتان بان ايران وبصفتها عضو في مجلس حقوق الإنسان، قد قبلت بـ "اعلاء اعلى المعايير لتعزيز وحماية حقوق الانسان".

I call on you to release them immediately and unconditionally since their detention is arbitrary, as it only seems to sanction their human rights activities. I also urge you to ensure that they have access to adequate medical treatment and put an end to all acts of harassment against all Iranian human rights defenders.

I call on you to ensure Mr. Butimar is granted a fair trial when appealing his sentence, and have unhindered access to legal representation.

Furthermore I urge you to conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its Article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels”, Article 6 (b) which stipulates that “everyone has the right […] freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms”, as well as Article 12(2), which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”.

Finally I urge you to ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with the Universal Declaration of Human Rights and with international and regional human rights instruments ratified by the Islamic Republic of Iran.

I hope for your urgent attention to this matter.
